The Duty to Protect Property Clause: Getting Steam Removal Reimbursed

Your policy requires you to take reasonable emergency steps after a loss, and to pay the reasonable cost of doing so. That clause is what funds ice dam removal.

The short version

The clause most homeowners never read is the one that pays for emergency ice dam removal. It also cuts the other way if the leak is ignored.

What the clause does

Standard forms place a duty on the insured to protect the property from further damage after a loss, and state that the carrier will pay the reasonable cost of those measures. Emergency steam removal while water is entering is precisely that measure.

Mitigation is frequently paid separately from the repair itself, and on many forms without a separate deductible. It is a different bucket from the interior repair scope.

The obligation runs both ways

If a known active leak is left alone and the ceiling fails two weeks later, the carrier can deny the additional damage as a failure to mitigate. Delay is not neutral.

Practically: photograph the dam and the interior water before work starts, call the carrier the same day, proceed with mitigation, and keep an invoice that separates emergency mitigation from any repair that follows. That separation is what makes the mitigation line payable on its own.
